Simon Kolawole: The more things seem to change… : NNPC FUEL SCARCITY AND CONTRACTUAL REPUGNANCY.
"A greedy, corrupt, and evil administration is bound to wither, sooner or later, in the face of obsessive desire and mounting clamour on the part of the masses of the people for a welfare regime which will benefit all equally. In the course of time there will be a clash of desires and wills between the exploiters and the exploited. These clash of desires and wills will stir the universal mind into action, and a situation will then arise which will bring about the termination of or radical change in the greedy, and evil regime." -Awo. The People's Republic, 1968
''The incompetence at the Nigerian National Petroleum Corporation (NNPC) is such that to draft a simple agreement for the supply of petroleum products under the offshore processing arrangement (OPA) is too much to ask. We ended up with agreements devoid of timeframes, and the traders smartly decided to supply in May — obviously playing the market''.-thecable.ng/things-seem-change
This is one of the manifestations of cronyism, influence peddling in recruitments into government establishments when competent people are deliberately left out of key positions instead they facilitate the employment of spouses girl-friends, concubines, sons and daughters of politically connected people without testing their skill sets, experiences, inclusive ability to perform effectively under pressure in a highly challenging work environment.
The situation you have described in your article ''things-seem-change'' is nothing new to me because of my experience working for Shell as a contract staff in the position of New Business Development Focal Point Officer in the Netherlands.
I used to cry for my beloved country whenever I read contracts and agreements written and signed by Nigerians on behalf of the Federal Government of Nigeria sometimes I wonder aloud in anger and exasperation, that was how intense and emotionally charged I felt to the repugnancy in those contracts and agreements.
Where is the patriotism of our leaders, workers, people in position of authority whose ultimate goals should be the maximum protection of the interest of Nigeria.
Just imagine a contract written for the supply of petroleum product to NNPC without a specific timeframe or sometimes agreements reached without any legal instruments to enforce such agreements, these are one of the most incredible things about contracts/aggreements that I have read while working in that department in those days.
Most heart wrenching was that all the contracts/agreements that I read in those days included clauses wherein every dispute or disagreements in respect of those contracts shall be resolved according to the laws of our foreign partners countries.
I wonder what in god's name is wrong with those people in the legal department of NNPC/SPDC they are the most unpatriotic saboteurs of our nation. Mostly badly written contracts and agreements also low level technician or sales men were given managerial positions to the exclusion of highly skilled Nigerian professionals, really these are all painful experiences.
This to me is a reflection of the disdainful lack of respect, if you like vote of no confidence in our legal cum judicial system to resolve contractual disagreements and Nigerians who are in positions of authority who should resist this kind of imposition just play along in the process selling Nigeria cheap.
Note: we have so many contracts and agreements like that on the shelves of legal departments of Ministries/Agencies of government.
Ibe kwackiku and President Muhammadu Buhari have a long road to walk to rid Nigeria and NNPC/SPDC of Vultures and Frankensteins of incompetency. This is the reality and they must make hay while the sun shines.
"We have in our midst about 1,000 rich Nigerians who in the past cleverly rigged the sources of the wealth of our nation, and we are now tactically poised to oligopolise all the munificent avenues of riches that may supervene now and in the future. The rich, and the highly-placed in business, public life, and government, are running a dreadful risk in their callous neglect of the poor and down-trodden." - Address delivered to Ondo House of Assembly (/980): Voice of Wisdom, 1981.
